Resolving Disputes 

​It is often said that construction projects always have disputes. Considering the complexity, high value, long project duration, different cultures and sometimes even individual personalities of the project team, it can be understood why disputes might arise. However, by implementing certain measures, the majority of disputes or for now let’s refer to them as ‘differences’ could be avoided or resolved amicably. The MGI team has significant expertise of putting in place and executing procedures and mechanism to help resolve matters amicably.


We have successfully helped clients avoid formal dispute proceedings such as arbitration or litigation, both of which can give rise to significant additional cost and be very demanding on management time. MGI Consulting can help implement the following which would support amicable resolution:


  • Identification of risks that impact the project and promote dialogue between the parties to investigate the management of such risks including updates.
  • Early warning – ongoing project monitoring so areas of concern are highlighted and addressed.
  • Strategies to develop trust and maintain relationships between the parties.
  • Hold meetings with the project team and provide real-time assessment of positions.
  • Facilitate meetings between Employer and Contractor senior management on a regular basis throughout the project so that key persons are well informed.
  • Settlement of differences/disputes by way of independent reviews of each of the parties’ respective positions.
  • Assist in the communication of any audit requirements in respect of substantiation of claims for additional payment or time and their settlement.
  • Endeavour to close open differences with the full agreement by the parties on a quarterly basis.
